Out of Country Refusals

Where an application for an entry clearance to the UK is refused, this may attract a right of appeal. Normally the deadline to submit an appeal against such a refusal is 28 days from the date of decision.

Once an appeal is submitted the Entry Clearance Officer will then review the initial decision and in light of the grounds of appeal and any fresh evidence. In limited circumstances, the decision of the entry clearance officer can be overturned. If the ECO decides to retain its decision the case will then proceed to a hearing before the First Tier Tribunal, Immigration and Asylum Chamber.

The appeals on entry clearance are bit lengthier than in country appeals. The out country appeal can take between 6-12 months to decide.
